Searching Palm Beach County Property Records
Palm Beach County runs from Jupiter down to Boca Raton along the coast, and west past Wellington and Belle Glade to the lake. Thirty nine municipalities sit inside it, the county seat is West Palm Beach, and the office you will deal with most carries a name that tells you something useful about how Florida works.
One clerk holds both the land record and the court file, which makes a good deal of research here simpler than it is elsewhere.
The Official Records are a single index
Florida counties file deeds, mortgages, assignments, satisfactions, liens, judgments, lis pendens, plats and covenants together in one series called the Official Records, maintained by the clerk of the circuit court and comptroller. Every instrument carries an Official Records book and page reference along with a clerk's file number.
That arrangement matters because the same office is also the clerk of the court. Florida forecloses through the courts, so a foreclosure produces a lawsuit, a recorded lis pendens, a final judgment and a certificate of title, and all of them land in the same index as the mortgage they are unwinding. A chain here reads unusually completely compared with a non judicial state.
The property appraiser holds the parcel control number, the ownership shown on the roll and the exemption status. The tax collector holds tax status and any tax certificates sold against the parcel. Both are fast routes from an address to a parcel, and neither is evidence of ownership.
Homestead here reaches past the deed
Two different rules share the word, and conflating them causes real trouble. The tax exemption reduces assessed value. The constitutional homestead protects the home from most creditor claims and, more to the point for a title question, restricts what the owner may do with it.
Where the owner is married, a spouse generally must join in a conveyance or mortgage of homestead property even when that spouse is not named on the deed. Where a spouse or a minor child survives, the ability to devise the home is limited. A deed signed by one person, perfectly regular on its face, can fail for a reason the instrument never mentions.
The record shows the deed, whatever marital status it recites, and the exemption code carried on the tax roll. Whether a property actually qualifies as homestead is a legal question for an attorney licensed in Florida.
Code enforcement liens and special districts
Thirty nine municipalities means thirty nine code enforcement departments. A Florida code enforcement lien can accrue daily, reach a surprising figure against a modest property, and once recorded it attaches like any other claim.
Special districts add a further layer. Drainage and water control districts across the agricultural west of the county levy assessments collected with the tax bill rather than recorded one by one, and a community development district financing infrastructure in a newer subdivision works the same way. Neither shows up as a recorded lien against an individual parcel.
Association assessments behave differently again. Florida uses a statutory estoppel certificate to establish the current figure at a closing, and that certificate comes from the association rather than from the county.
What to send us
The address, and the parcel control number if you have it. The full name of every owner across the period you care about, including trust names written exactly as they appear. The municipality, because a county index does not carry a city code enforcement ledger. And the term you want searched, since a current owner search and a full chain answer different questions.
What a Palm Beach County search establishes
A search reports what was recorded and found in the indexes reviewed over the term searched, in the county where the property sits. It is not an inventory of everything affecting a property, an empty result does not prove a parcel is unencumbered, and recording practice varies from one Florida county to the next. Whether title is good, whether a homestead restriction applies, and whether a recorded claim remains enforceable are conclusions for counsel rather than findings in a report.
